My financial adviser has informed me that I have to pay Accord Mortgages fees should I instruct my family lawyer. How efficient are the Accord Mortgages conveyancing panel solicitors? I dont care which law firm I use as long as they're good and not exorbitantly priced. Would you recommend a specific law firm on the Accord Mortgages panel?
Accord Mortgages’s conveyancing panel is pretty large so your best bet is just to check with the firms you are getting quotes from whether they are on it. You can search by postcode on the search tool on this site to find solicitors that Accord Mortgages will allow to act for them.
Our lawyer has discovered a problem with the lease for the apartment we are purchasing. The other side have offered defective title insurance as a solution. We are content with insurance and will cover the costs. The short answer to your last question is that, notwithstanding the potential for a conflict of interest, you and Accord Mortgages are the client. A precondition to being on the Accord Mortgages approved panel is to comply with the CML Handbook requirements (last updated for this lender on Accord Mortgages). The CML Handbook conditions require your lawyer to disclose issues such as defects will the lease so that Accord Mortgages can be afforded the opportunity to check with their valuer as to the extent that the value of the property is affected . Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for you.
Do all the licensed conveyancers and solicitor practices listed on your directory have online case tracking as I was under the impression that this was a precondition of being on the Accord Mortgages solicitor panel?
No. There is no CML Part 2 or Building Society Association requirement relating to online case tracking. Some law firms operate such technology and some don't.
My solicitors in Birmingham have advised me that they can not locate my conveyancing file. To assist with my purchase I took out a mortgage with Accord Mortgages. Is it case that being on the Accord Mortgages conveyancing panel they need to have retained the file for a prescribed period?
Different lenders have different requirements but many of the Terms and Conditions of Conveyancing Panel Appointment require the file to be held for a period of 6 years. If you are getting a mortgage with Accord Mortgages involved you will need to appoint a solicitor on the Accord Mortgages conveyancing panel. We would not encourage you to both use the same solicitors' firm. There are clear conflict of interest issues and it's not going to make a huge difference to the speed of the overall process. So as not to hold things us you should pass on your solicitors details to Accord Mortgages. I have a mortgage with Accord Mortgages. My grandfather has just retired and wants to pay off my mortgage. Although you do need to retain the services of a lawyer they dont
need to be on the Accord Mortgages panel.
You will need a solicitor to draw up the transfer and
to deal with the Land Registry formalities. The only thing you need to
consider is that by selling at an undervalue so ask your lawyer about
the implications. There could be an inheritance tax issue if you die
within 7 years of this. As the property is your main residence you need
not pay CGT but you should speak with your accountants in any event.

It is usual to have concerns where there is a chain as you are unlikely to want to be too out of pocket too early (mortgage application is approx £1k, then survey/valuation, conveyancing search costs, etc). First you should check that your solicitor is on the Accord Mortgages conveyancing panel. As to the next stages this very much depends on the circumstances of your case, desire for this property and on the state of the market. In a hot mortgage some buyers would pally for the mortgage with Accord Mortgages and pay for the valuation and only if it comes back ok would they pay their solicitor to press on with searches.
