Is it realistic for conveyancing in Allendale to be concluded in under 3 weeks?
First, If you are under time constraints to sign contracts it is advisable to make sure that your lawyer is familiar with the area as they will benefit local contacts and know-how. It is possible that they could have handled otherproperties in the same neighbourhood. You would be best advised to use a Allendale conveyancing solicitor. In addition, double check that the lawyer is on the lender panel. It is claimed that 18% of Allendale conveyancing transactions are frustrated or jeopardised after discovering a buyer’s solicitor was not on their banks list of approved solicitors. This can often result in the conveyancing being held up by as much as 21 days. It is estimated that this issue impacts in the region of one hundred thousand home sales every year. Most Allendale conveyancing practices can not act for certain lenders so do check at the outset.
We had chosen conveyancing lawyers locally in Allendale on the Virgin Money solicitor panel. They have just billed me an additional sum for dealing with the Virgin Money mortgage. Is this a supplemental conveyancing fee set by Virgin Money?
Provided it is contained in their Terms of Engagement or estimate then yes your property lawyer can charge a fee for this. The charge is not set by Virgin Money but by your Allendale solicitor. Plenty of firms on the Virgin Money panel will levy an ‘acting for lender’ fee and others do not.
I had a mortgage agreed in principle with Principality. Allendale conveyancing practitioners are instructed. How long does it take for Principality to forward the offer to the conveyancer?
There is no definitive answer here. Have Principality completed the valuation? Have you informed Principality as to your lawyers' details and checked that your lawyers are on the Principality conveyancing panel? Sometimes it can take as long as six weeks for a mortgage offer to be issued.
I am selling my house. I had a double glazing fitted in December 2006, but did not receive a FENSA certificate or Building Regulation Certificate. My purchaser’s mortgage company, Skipton are being difficult. The Allendale solicitor who is on the Skipton conveyancing panel is recommending indemnity insurance as a solution but Skipton are requiring a building regulation certificate. Why do Skipton have a conveyancing panel if they don't accept advice from them?
It is probably the case that Skipton have referred the matter to their valuer. The reason why Skipton may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing was correctly and safely installed. The indemnity insurance merely protects against enforcement action which is very unlikely anyway.
Me and my brother own a semi-detached Georgian property in Allendale. Conveyancing lawyer represented me and Barnsley Building Society. I happened to do a free search for it on the Land Registry database and there are two entries: one for freehold, the second leasehold under the exact same property. I'd like to know for sure, how can I find out??
You should assess the Freehold register you have again and check the Charges Register for mention of a lease. The best way to be sure that you are also the registered owner of the leasehold and freehold title as well is to check (£3). It is not completely unheard of in Allendale and other locations in the country and poses no real issues for owners other than when they sell they have to account for both freehold and leasehold interests when dealing with lenders. You can also check the position with the conveyancing lawyer who completed the work.
Due to the advice of my in-laws I had a survey completed on a property in Allendale in advance of instructing solicitors. I have been advised that there is a flying freehold element to the property. Our surveyor advised that some banks tend refuse to give a mortgage on this type of home.
It varies from the lender to lender. Bank of Scotland has different instructions for example to Birmingham Midshires. If you e-mail us we can investigate further via the relevant lender. If you lender is happy to lend one our lawyers can help as they are used to dealing with flying freeholds in Allendale. Conveyancing can be more complicated and therefore you should check with your conveyancing solicitor in Allendale to see if the conveyancing will be more expensive.
My wife and I have recently had an offer accepted on a apartment and had an appointment on Tuesday with the Post Office for the mortgage. They advised us that when it comes to appointing a lawyer that if they are not on their approved list of conveyancing practitioners then we will have to pay out an additional charge of £200. This is because they will then have to appoint a property lawyer to act for them as well as the one we select for ourselves and we assume responsibility for their costs. I have requested the Post Office to send me with a list so I can obtain quotes only from their approved solicitors but was told they dont have such a list to hand over. Is there a list online?
Ask the Post Office what their criteria for panel membership is for a solicitor.Thereafter ask the conveyancer of your choice whether they fit that criteria and have they acted on mortgages for the Post Office in the past. Where the answer to those is yes, then just clarify this with the Post Office. Another option is to utilise our search facility and we should be able to find you a conveyancer in Allendale on the approved list for the Post Office.
